Unsuitability, Negligence, and Churning Allegations

In the latest customer complaint, brought in July 2020, the investor is alleging negligence, breach of fiduciary duty, broker fraud, and breach of contract and is seeking $100K in damages. On BrokerCheck, DiPietro commented that he is not formally a respondent in the case.

Another still pending investor claim, brought in August 2019, alleges that this Boca Raton broker made unsuitable recommendations. The claimant is requesting over $68K in damages.

An earlier customer dispute from 2018 accused DiPietro of unsuitability and churning during his time as a Dawson James Securities broker and a Dawson James Asset Management investment advisor. The investor had requested $100K in damages. The Financial Industry Regulatory Authority (FINRA) case was settled for $10K.

Two 2014 customer complaints alleging a failure to follow orders were withdrawn. Two other disputes from 2013 that made similar allegations were denied.

Another unsuitability claim, from 2012, was settled by DiPietro’s former employer, brokerage firm Chicago Investment Group, for $20K. Still another unsuitability case involving the Florida stockbroker, this one from 2011, was denied.

The first securities fraud claim involving DiPietro was filed in 2008. The case, alleging failure to supervise, unsuitability, and churning, was settled for $160K.

During his 19 years in the industry, other firms that Paul DiPietro worked for included broker-dealers Investors Capital Corp., GunAllen Financial, KSH Investment Group, and Global Capital Markets. He also used to be an investment advisor for Investors Capital Advisory and worked at a few other firms that are not named in his BrokerCheck record.
