Cogburn Jr. said that <a href=\"https:\/\/www.investorlawyers.com\/bank-of-america-background-information.html\">Bank of America Corp. (BAC)<\/a> would have to face government two <a href=\"https:\/\/www.investorlawyers.com\/derivative-securities-derivatives-mortgage-backed-securities-mbs.html\">residential mortgage-backed securities lawsuits<\/a>. The Securities and Exchange Commission and the Department of Justice contend that the bank misled investors about the quality of loans tied to $850 million in RMBS.<\/p>\n<p>Bank of America wanted the cases dismissed. It argued that the investors, both financial institutions, never sued the bank.<\/p>\n<p>Judge Cogburn, however, found that the SEC\u2019s lawsuit properly laid out that the bank lied about the mortgages\u2019 projected health in its RMBS fraud case. With the DOJ\u2019s case, he gave the department 30 days to revise its securities lawsuit.
