This latest Inspired Healthcare Capital loss lawsuit involves an older investor who entrusted part of his retirement savings to the Respondents. They, in turn, unsuitably recommended an IHC DST. That this is a privately traded, illiquid product makes this kind of Regulation D offering particularly bad for retirees and near retirees.

This Claimant contends that Po used their shared cultural affinity to gain his trust. Seeing as Emerson Equity is the underwriter, managing broker, and sole marketer of all IHC products, there was already a conflict of interest. The Respondents earned a multi-layer of fees from the transactions of up to 12.5%

In his FINRA lawsuit to recoup his Inspired Healthcare Capital DST losses, our Client is alleging unsuitability, misrepresentations and omissions, negligence, fraud, Regulation Best Interest violations, overconcentration, breach of fiduciary duty, breach of contract, and more. This investor is looking at a near-total loss of his entire principal and everything he entrusted to the Respondents.

More Than Two Dozen Customers Of Broker Peter Po Have Filed Investor Lawsuits

This is not the first time that Shepherd Smith Edwards and Kantas has filed an investment loss recovery claim on behalf of former customers of longtime financial advisor Peter Po. We filed another IHC recovery lawsuit against Po and Emerson Equity late last year. We also represent investors against Ni Advisors from when Po was a registered representative for that firm.

Peter Po’s BrokerCheck CRD notes list 28 other Customer Disputes, which were settled or remain pending. The majority of the investor lawsuits were brought starting in 2021.
