Unsuitability Exposes Investors To A Higher Risk Of Loss

FINRA Rule 2111 Lists Three Suitability Obligations That Brokers Have To Fulfill:

Reasonable-basis: The broker must have reasonable grounds for believing, after conducting reasonable due diligence, that a recommendation is appropriate for at least some investors.

Customer-specific: Based on the customer’s investment profile, the broker has reasonable grounds for believing the recommendation is suitable for this investor.

Quantitative Suitability: The broker has reasonable grounds for believing that a series of transactions being recommended is suitable when taken collectively, given the customer’s investment profile.

Unsuitability is the foundation of most Oregon investment loss recovery claims.
