San Diego Retiree Sues Emerson Equity and Brokers Over Now Rebranded Versity Investments/Crew Enterprises Product
Are You An Investor Who Suffered Losses in Nelson Brothers Student Housing Fund III?
Shepherd Smith Edwards and Kantas Private Placement Loss Attorneys are representing a San Diego retiree in a six-figure claim against Emerson Equity and brokers Brian Jenson Nelson and Julie Ann Reyes over losses in Nelson Brothers Student Housing Fund III. The lawsuit alleges that the illiquid private placement was unsuitably recommended and follows serious fraud accusations involving the misappropriation of $56M by Versity/Crew Enterprises.
Shepherd Smith Edwards and Kantas Private Placement Loss Attorneys (investorlawyer.com) are representing an elderly widow in her six-figure investment loss recovery claim against brokerage firm Emerson Equity, control person Dominic Julio Baldini, and brokers Brian Jenson Nelson and Julie Ann Reyes. The Claimant, a San Diego investor, is seeking up to $500,000 in damages over losses in Nelson Brothers Student Housing Fund III, which was issued by Versity /Crew Enterprises.
This is one of a number of Versity/Crew Enterprises loss claims we have recently filed on behalf of an investor.
Facts from this case:
- Emerson Equity is the underwriter for Nelson Brothers Student Housing Fund III, which is a privately-traded Fund made up of student housing properties.
- This was an unsuitable recommendation for an older, inexperienced investor who did not want to take on undue risk.
- In her FINRA lawsuit, she is also alleging overconcentration, Regulation Best Interest violations, misrepresentations and omissions, negligence, breach of contract, breach of fiduciary duty, fraud, vicarious liability, and more.
- It appears that the Respondents never fully explained to this investor not just the extreme risks involved with private placement funds, but also the multiple layers of fees she would be charged.
Emerson Equity broker Brian Jensen Nelson has 21 disclosures listed in his BrokerCheck CRD, including 16 customer disputes. Many of these were filed in the last few years and are pending/were settled, including at least two six-figure settlements. Allegations against him include different kinds of broker misconduct.
Julie Ann Reyes, who was an Emerson Equity broker for six years, is a registered investment adviser with Reyes Financial Architecture. At least two customer disputes involving her former Clients resulted in settlements.
What Is Nelson Brothers Student Housing Fund III, and Why Is It In Trouble?
- This real estate investment vehicle was heavily involved in student housing.
- It has faced lawsuits and been dealing with financial woes for some time.
- Founder Brian Nelson later separated from Nelson Brothers Professional Real Estate to establish NB Private Capital, which was later rebranded as Versity Investments and now Crew Enterprises.
Versity/Crew Enterprises and those running it are accused of a $56M investment fraud that allegedly involved misappropriating investor monies for personal use and to fund other real estate transactions.
